Ongoing Engagements:

Vineyard Investigations v. E. & J. Gallo Winery

Representing soil scientist, viticulturalist, and inventor Dr. Paul Skinner in enforcement of a patent portfolio related to intelligent control of irrigation and chemical delivery in vineyards and fields. Prevailed in all phases of ongoing litigation against Gallo, including defeating a patent ineligibility motion, defeating three inter partes reviews and subsequent reexamination requests, and winning favorable claim constructions. Dispositive motions are pending.

American GNC Corp. v. Nintendo

Representing MEMS motion sensor pioneer American GNC in asserting two of its foundational patents against Nintendo’s Switch consoles and controllers in the Western District of Washington. Defeated an initial patent ineligibility motion in ongoing litigation. Case is currently on appeal to the Federal Circuit, from certain adverse rulings by the PTAB.

Past Matters For Plaintiffs:

Ramot at Tel Aviv University Ltd. v Cisco

Brought and led multi-venue litigation in Texas, Delaware, the U.S. Patent Office, and the Federal Circuit, enforcing a portfolio of high-speed optical communications patents on behalf of Ramot and its Tel Aviv University researchers. Among other victories, completely defeated nearly two dozen proceedings and appeals brought by Cisco to challenge patent validity, without a single patent claim being invalidated.

Theta IP, LLC v. Samsung, Motorola, Apple

Represented Theta IP in a patent infringement action against Samsung in the Western District of Texas relating to technology for power savings in cellular receivers. After defeating Samsung’s numerous dispositive motions, we achieved a very favorable resolution as the jury was en route to the courthouse.

Then brought and led Theta’s subsequent litigations against Apple in the Western District of Texas, and against Motorola and parent Lenovo in the Northern District of Illinois. Early victories included defeating Apple’s motion to transfer, winning all claim construction disputes, completely defeating Motorola’s inter partes reviews, and defeating challenges in two of Apple’s inter partes reviews.

TOT Power Control S.L. v. Apple and others

Joined team preparing cases for trial against Apple, Samsung, and LG. Prepared infringement contentions, assisted with claim construction, and took key fact and expert depositions. The first case was tried against Apple in Delaware, leading to a $111 million dollar verdict.

Lambeth Magnetic Structures, LLC v. Western Digital Corp. and Seagate

Represented LMS and Prof. Lambeth in enforcement of a magnetic material structure patent, directed to fundamental improvements in data storage density. Defeated summary judgment motions, leading to mediation and favorable settlement with Western Digital. Tried a separate case against Seagate to a mixed verdict in Pittsburgh, which was appealed to, reversed by, and remanded by the Federal Circuit for a new trial.

Image Processing Technologies, LLC v. Samsung Electronics Corp.

Joined trial team asserting an image detection and facial recognition patent as part of a long-running litigation in the Eastern District of Texas. Achieved a string of pre-trial motion victories, and a favorable settlement just before trial was to begin.

Daedalus Blue, LLC v. Microsoft Corp., and others

Helped to develop cases and litigate a portfolio of foundational cloud computing patents, against alleged infringement by Microsoft Azure, as well as platforms from Oracle and Microstrategy. Achieved favorable settlements in each case.

Founders and Shareholders v. Technology Company

Recovered tens of millions on behalf of sellers of acquired sensor technology, in a contractual indemnity action that was tried to an arbitrator and concerned settled patent and trade secret litigation.

DIRECTV, Inc. v. Confidential Indemnitor

Successfully represented DIRECTV in all aspects of a breach of contract arbitration that was tried to a three-judge panel and concerned indemnity for patent infringement claims. Won an award and completely defeated counterclaims that were together worth more than $75 million dollars.

Comcast Cable Communications, LLC et al. v. BT Americas et al.

On behalf of Comcast, defensively asserted multiple networking technology patents in the Northern District of Texas. Obtained a favorable settlement.

Past Matters for Defendants:

Symantec Corp. v. Zscaler, Inc.

Defended cloud network security startup Zscaler in a fourteen-patent litigation in Delaware and the Northern District of California. Argued for and secured dismissal of two patents as invalid for subject matter ineligibility.

CA, Inc. d/b/a CA Technologies v. New Relic, Inc.

Argued for and obtained summary judgment of non-infringement on behalf of application performance management startup New Relic, leading to dismissal of competitor litigation in the Eastern District of New York.

EMC Corporation v. Pure Storage Inc.

Represented data storage innovator Pure Storage in a five-patent lawsuit in the District of Delaware. Defeated two patent assertions before trial, obtained jury verdicts of non-infringement as to two others as well as a verdict of zero lost profits, and won partial judgment as a matter of law and a new trial on invalidity as to the last, prior to a favorable global settlement.

Round Rock Research, LLC v. SanDisk Corp.

Assisted in all aspects of defense of multiple flash memory patent cases. Helped to obtain a jury verdict of invalidity in one Delaware trial, and dispositive motion wins in other cases, leading to a favorable global settlement.

Ericsson Inc., et al. v. D-Link Corp., et al.

For Qualcomm and associated joint defense group parties, assisted lead trial counsel in preparation of arguments, strategy, and cross-examinations, in Eastern District of Texas trial concerning several standard essential WiFi patents from Ericsson. Obtained a noninfringement verdict against two patents and judgment as a matter of law against a third.

Suffolk Technologies LLC v. AOL Inc. and Google Inc.

Represented defendants in advertising technology patent litigation in the Eastern District of Virginia. Obtained summary judgment of invalidity as to most claims and exclusion of plaintiff’s damages expert report on the eve of trial, which were upheld on appeal after stipulated dismissal of the remaining claim.

DIRECTV, Inc.

Successfully defended DIRECTV in multiple patent infringement actions involving various aspects of direct broadcast satellite television technology, interactive program guides, and settop box functionalities.
